ACCOMMODATIONS AGREEMENT & CANCELLATION POLICY This contract constitutes a legally and binding electronically signed agreement between the signed guest and Paradise Properties USA, Inc (PPUSA), to occupy the premises described on this contract as: GUEST UNDERSTANDS AND AGREES:


1. Your initial credit card payment equaling ½ of the total balance plus the security deposit taken at the
time of reservation, is a deposit to secure your reservation for the dates you have requested
2. FINAL PAYMENT – The remaining balance will be due in full at least 30 days prior to your check in
date. This payment can be taken by Visa, Master Card, American Express, Discover.
3. AUTHORIZATION TO CHARGE CREDIT CARD-By signing this contract, you are authorizing PPUSA to
charge your credit card number given; (over the phone/via email/or as written on this contract) for any
current and future payments required as specified in this contract, when due.
4. IMMEDIATE RESERVATIONS- If your reservation is made within 45 days of your check in, the total
balance will be due in full including security deposit. A reservation made less than 45 days in advance
may only be paid by Visa, Master Card, American Express or Discover at the time of reservation.
5. COLLECTION OF SECURITY/DAMAGE DEPOSIT- This deposit will be returned as outlined in section
‘C’. Guest agrees not to “dispute”, “contest” or take any action, legal or otherwise against PPUSA or
the homeowner, against any security/damage or reservation deposit being held and used for the sole
purpose of forfeiture of this contract or damage to the property. (See section ‘C’ Damage).

For a full refund of your deposit, PPUSA requires written notice(email) at least 90 days prior to your
check in. If cancellation is made less than 90 days prior to your check in you will forfeit all funds paid to
that point, unless PPUSA successfully secures another rental for that same time period. All cancellation
shall be subject to a cancellation fee of $100.

Guest agrees to reimburse owner for any damage to the dwelling and property over and above the
security/damage deposit secured by PPUSA. Guest also agrees that if any damage to property,
furnishings, equipment and household items, therein, which occur during the guest’s period of
occupancy, whenever such damage thereto will have resulted from guest’s misuse, waste or neglect or
that of guest’s invitee. PPUSA will hold and/or apply the security/damage deposit to make necessary
repairs, provide extra cleaning or replace damaged items. Security/damage deposit will be returned
only after home is inspected by authorized person and returned if no damage incurred, usually within
twenty (20) business days after guest departure. Keys are to be returned to PPUSA office at 9047
Helena, Alden, MI. Renter will be charged for lock replacement in the event of lost or unreturned keys.
A fee of $100 will be charged for keys left in the rental upon departure.

1. Below, signed renter agrees that they are a minimum of 25 years of age. Valid identification will be
requested at any time and WILL be required at check in.
2. Smoking and pets are not permitted. No exceptions will be made.
3. If your rental unit has a telephone all long distance calls must be made at the guest expense via
collect call, calling card or credit card.
4. During the rental period the guest is required to maintain the cleanliness of the home. Homeowners
trust that you will respect their home as your own.
5. Maximum number of contracted guests to be allowed on premises varies with properties. Over the
maximum allowed guess will be a Violation of the maximum number of occupants indicated & will
result in immediate eviction and forfeiture of all monies paid. Refunds will not be issued. Occupancy is
strictly enforced and randomly checked. Day guests that exceed the maximum number of guests
allowed must be approved by PPUSA.
6. If guest or any member of his/her party violates any of the conditions of this agreement, PPUSA, Inc
or the homeowner may terminate this agreement and immediately evict renters. All payments are
then forfeited by renter.
7. Fireworks of any kind are not allowed whatsoever on or near rental property! Immediate eviction and
forfeiture of all money paid will be strictly enforced.
8. This property, its owner’s and agents, observe zero tolerance for any and all illegal activities.
9. Absolutely NO TENTS, CAMPERS or RV’s are allowed at any rental home or condo at any time. m   10.Guest is responsible for bringing sheets towels and paper products, unless specified otherwise.

E. Acknowledgements:
1. That the accommodation is a privately owned dwelling with the owner’s furnishings and that the
owner is not responsible for providing any additional furnishings or equipment. Features and
amenities are subject to change without notice. Information regarding the property and/or amenities
may have been gathered from a third party source. All information is deemed reliable, but not
2. The owner, or a representative thereof, may enter the premises for the purpose of affecting necessary
repairs and/or maintenance.
3. The guest acknowledges and understands that he/she is a guest of the owner, not a tenant, and
therefore is not acquiring any interest in the property. Use of the property is subject to the owner’s
right of possession thereof. 4. PPUSA, its owners and the homeowners on our programs will not
assume any responsibility or liability due to unforeseen circumstances above and beyond our control.
The Guest agrees to indemnify and hold PPUSA harmless from and against all actions, suits, damages,
judgments, costs, charges, expenses, attorney fees, and consequences of any liabilities, of any nature,
resulting from or in connection with the guest’s use of the premises or the use of the premises by any
member of the guest’s party. Furthermore, PPUSA may terminate this Agreement at any time if any
law or ordinance, or any interpretation thereof, prohibits or is deemed to prohibit the guest’s rental
and use of the premises.
5. In the event the owner of the rental property forces the cancelation of this reservation for any reason,
PPUSA will make every effort to relocate the reservation or refund all payments by renter in full. This is
an extremely rare occurrence.

• Watercraft Storage:
Although it is convenient to keep your boat in the water during your vacation please take note of
weather and lake conditions when securing your boat for extended periods of time. Many of our
waterfront homes offer a dock, mooring anchor and/or a boat hoist. Tying up to the dock on Elk and
Torch Lakes is strictly prohibited. Mooring anchors are usually sufficient for lightweight, calm water,
daytime use. Use of a hoist at a home that offers one must be prearranged and the boat must be
within the size and weight capacity of the hoist. Use of all watercraft storage facilities is done at your
own risk and Paradise Properties USA, Inc., or the property/homeowners will not be held responsible
or liable for any property damage and/or personal injury resulting from the use of a boat storage
facility. Furthermore, any damage cause to watercraft storage facilities due to renter’s improper use
will be repaired or replaced at the renter’s expense. If you feel the boat accommodations provided are
not suitable or adequate for your boating equipment, there are several area marinas that rent slips or
dry dock storage spaces for your use during your vacation. Please contact us for a list of marinas
nearest the home you are renting. Refunds will not be issued for boat storage facilities that you feel
are inadequate or unsuitable.


The undersigned, in consideration of the use of the Facility, hereby releases, forever discharges and indemnifies PPUSA, its employees, agents, shareholders, officers, directors, successors, assigns, and home owners from any and all liability for any loss, cause of action, damage, personal injury or property damage sustained by the under-signed, his family, guests, representatives and successors entering upon, using, or in the proximity of, the Facility or any part thereof.

The undersigned recognizes that but for the entry into this Release and observance of its full terms, PPUSA would not allow the entry upon, or use of, the Facility or any part thereof and PPUSA is relying upon this Release in allowing such access.

PPUSA has made no and makes no representations, warranties or assurances as to the condition of any part of the Facility including, but not limited to, its safety, function or exclusive use. PPUSA is under no obligation to, and the undersigned specifically waives any right to, the provision of any safety precaution, warning or other safety device related to the Facility and is under no obligation to inspect, repair or advise the undersigned of any condition or defect of the Facility.

The undersigned accepts the Facility in its present condition and represents and warrants that the undersigned is familiar with the Facility and its operation and use and will use it only in a safe and proper manner.

The undersigned represents that they are under no legal impediment preventing the execution and full effect of this Release and has the full authority to execute this Release on behalf of all others identified for which the undersigned is made responsible hereby.

The undersigned further agrees to release, indemnify and hold harmless PPUSA, its employees, agents, shareholders, officers, directors, successors, assigns and home owners from any loss, cause, damage or lost benefit, including attorneys fees resulting from or relating to the use of the Facility by the undersigned, his family, guests, representatives or those entering upon, using, or in proximity to, the Facility by, through or under the undersigned.

In the event that any claim should be made against PPUSA as a result of the use of the Facility by, through or under the undersigned, the undersigned agrees to reimburse upon demand PPUSA for all costs associated with such claim, including, but not limited to, all costs of defense.
